VACATION RENTAL AGREEMENT

This agreement is hereby made between Jardon and Sylvia Boehme, Owners and Eric Boehme,
Manager (also referred to as We, Our, Us), and
________________________________, Tenant, concerning the short term
rental of the property located at 202 Sandia, Ruidoso, NM.

BOOKING POLICIES: Please follow the procedures outlined on the online booking page to reserve this property.
You may book online with a credit card and reserve the property immediately. It won't be charged until we review the information.
All reservations require a 50% reservation deposit unless your arrival date is 30 days or less in the future, in which case, the entire reservation amount,
including any taxes, fees and other deposits is required to make the reservation. Once we confirm the credit card information, we will process and
charge your credit card for 1/2 of the rental charges - including fees and taxes (8.32%). Final payment is due 30 days prior to
arrival and will include a $150 refundable damage deposit. (see below for details).
Until your credit card is charged AND we receive this agreement back (w/ your information typed or signed in), it may be cancelled.
Once your credit card is charged and we receive a copy of signed rental agreement, we will secure your vacation . This is a first come, first
served basis.
CANCELLATIONS: If you are unable to initiate your stay and
notification is received by manager at least 30 days prior to check-in date,
your payments are 95% refundable (to account for credit card and handling fees ).
However, if cancellation notice is given by tenant within 30 days of check in
date, we have the right to retain all funds (except refundable damage deposit
and cleaning fee) at our discretion. Refunds for uninitiated stays, if any,
will be based upon our best efforts to re-rent the property for the same period.
| - WARNING ! Use of hot tubs present multiple
risks of injury or death. Please observe proper safety precautions and
supervision of children at all times. |

- We provide towels, linens, toilet paper, paper towels,
other common consumables, and basic kitchen necessities. |
| - The outside of the front of the house may have
a security camera for monitoring purposes. |
- As stated above, a $150.00 refundable damage deposit is required - and will be charged at final payment.
The deposit will be refunded provided that the following conditions are met:
*The Lessee will keep the premises in as good repair as found at the inception of this lease
(wear and tear arising from a reasonable use of the same, and damage from the elements occurring without fault or neglect of the
Lessee excepted), as at the expiration of lease term.
- No evidence of smoking inside the cabin is detected.
- No evidence of pets having been inside the cabin is detected.
- No more than 10 people occupied the property during rental period
- All contents of the cabin are accounted for by maid service.
- No trash should be left on the premises. This includes the garage. Please take your trash to one of the dumpsters down the road next to the property as
they are for public use.
- The gas grill should be cleaned of any food particles after use.
- DO NOT USE CHARCOAL in the gas grill. This will result in a damaged grill that needs to be replaced.
- No excessive cleaning is required. This includes spills in the refrigerator and on stove top or oven. Normal cleaning on the stove will include replacing the foil under burners and wiping/sanitizing top. Any evidence of spills that require housekeeper to look under stove top and clean will be additional cleaning charges. Any spills in the refrigerator or freezer that require extra cleaning may result in charges. The garage should not have any stains or trash left upon departure. Trash bags are provided.
Dirty trash cans should be washed. Also, damage or stains to carpet will result in extra cleaning charges.
- It is NOT necessary to launder any of the linens when you vacate the premises. If one or more of the beds are not used, please leave a courtesy note to the cleaning service so that they do not wash a clean set of sheets.
Based upon our cleaning service's
review of inventory, unit flooring/carpet, furnishings conditions, and any
damage, breakage or excess cleaning attributed to wear and tear in excess
of normal use, costs attributed to repairs, loss and/or damage will be
charged against tenant's . Loss exceeding the
security damage deposit amount will be charged to the tenant. An itemized
statement will be provided.
Should damages be incurred, Lessor will provide Lessee with written notification and documentation of damages
and related charges necessary to restore property to its original condition. |
| - Upon notification of the malfunction of any of the
cabins amenities (TV, Phone, Hottub,etc) we shall make every effort to
repair in a timely manner, but do not make any guarantees or give any
refunds due to such malfunctions. We do not provide direct dial long
distance telephone service at the cabin. |
| - The tenant shall maintain the premises in a good, clean
condition and not use premises for any unlawful purposes, nor violate any
law or ordinance. The tenant shall not commit waste or nuisance upon or
around the premises. Due to the black bear population, please do not
put trash or food outside the house or in your vehicle, trash may only

| - There are often times that any type of outdoor fire
including smoking outdoors is prohibited by local authorities, please
check the fire restrictions at the time of your visit at: http://www.ruidoso.net/forestconditions

| - If state and/or local authorities order a mandatory
evacuation of an area that includes the premises or road closures that
prevents tenant from occupying the premises, a nightly prorated refund
will be issued. If state roads are open and tenant chooses not to begin
occupancy, no refunds will be given. The cabin is in a hilly area and 4
wheel drive vehicles are helpful, sometimes recommended - in winter snowstorms.

| - The tenant shall not sublet the property nor
have more than 10 persons residing or sleeping on the premises.

| - The tenant and tenant's guests shall hereby
indemnify and hold harmless the Manager and owner against any and all
claims of personal injury or property damage or loss arising from use of
the premises regardless of the nature of the accident, injury or loss.
Tenant agrees to pay all reasonable costs, attorney's fees and expenses
that shall be incurred by Manager or owner due to enforcement of this
agreement. Tenant agrees that the Manager or their respective
representatives may enter the premises with notification during reasonable
hours to inspect the premises, to make repairs or to show the premises to
prospective purchasers or tenants. Should the tenant violate any of the
terms of this agreement, the rental period shall be terminated
immediately. The tenant shall vacate the premises at the expiration time
and date of this agreement. |
By signing or typing your name below, you are acknowledging that you
have read, understand and accept this Vacation Rental Agreement, and you agree
to its terms, rules and conditions. In addition, you agree to convey such terms,
rules and conditions to any and all occupants during your
stay.
